BACKGROUND:
This agreement applies as between you, the User of this Website and Cricket Properties Ltd (CPL), the owner(s) of this Website. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.
1. Definitions and Interpretation
In this Agreement the following terms shall have the following meanings:

means you, the user of the Wisden Site, and “Your” should be interpreted accordingly,

2. Intellectual Property
- 2.1 Subject to the exceptions in Clause 3 of these Terms and Conditions, all Content included on the Website including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of CPL, or our affiliates. By continuing to use the Website you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other laws.
- 2.2 You may print, reproduce, copy, distribute, store or in any other fashion re-use Content from the Website as specified in Clause 4 of these Terms and Conditions and for personal or educational purposes only unless otherwise indicated on the Website or unless given express written permission to do so by CPL. Specifically you agree that:

- 3.3 Any dealings between You and any third party advertisers or merchants found on or via wisden.com, including payment for and delivery of products, services and any other terms, conditions, warranties or representations associated with such dealings, are made between You and the relevant advertiser or merchant. Therefore, We are not responsible or liable for any loss or damage of any kind incurred as the result of any such dealings. Where You purchase goods or services directly from Us, section 11 of these terms and conditions will apply.
4. Third Party Intellectual Property
- 4.1 The Intellectual Property Rights subsisting in Comments belong to the Users who posted those Comments unless it is expressly stated otherwise.
- 4.2 Where expressly indicated, certain Content and the Intellectual Property Rights subsisting therein belongs to other parties.
- 4.3 The Content described in this Clause 3, unless expressly stated to be so, is not covered by any permission granted by Clause 2 of these Terms and Conditions to use Content from the Website. The exceptions in Clause 4 continue to apply.

8. Posting Comments
- 8.1 When posting a Comment on an Article you should do so in accordance with the following rules:
- 8.1.1 you must not use obscene or vulgar language;.
- 8.1.2 your Comment may not contain Content that is unlawful or otherwise objectionable. This includes, but is not limited to, Content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist;
- 8.1.3 your Comment may not contain Content that is intended to promote or incite violence;
- 8.1.4 your Comment should be honest and fair, should not make any unsubstantiated or unsupportable claims, and should not unreasonably criticise other Comments or Users;

In cases of severe breaches of the provisions of sub-Clause 7.1, your Comment may be removed and your Account may be suspended or terminated. You will not be informed in writing of the reasons for any such alterations or removals.

9. Liability
- 9.1 Material which is posted on any bulletin boards or chat forums is written by Users and We are not responsible for and do not endorse such material. We reserve the right to monitor the contributions made and may respond to or comment upon communications made by You and edit, refuse to post, or remove any content from the bulletin boards and chat forums in our absolute discretion. 10. Competitions
- 10.1 The competitions that we run through the Services are subject to the following rules (unless otherwise specified):
- 10.1.1 No purchase is necessary..
- 10.1.2 One entry is permitted per household, and no bulk or third party entries are permitted.
- 10.1.3 Competitions are open to all UK residents (over the age of 18 in alcohol, tobacco or travel-related competitions, and in other cases as stated) except our employees, the companies or organisations with whom the competition or offer is being run, their agents, or anyone directly connected with the promotion.
- 10.1.4 Proof of entry will not be accepted as proof of receipt of entry.
- 10.1.5 If we run a competition or offer with a promoter where that promoter is responsible for the provision of the offer or prizes then CPL will not be responsible for or have any liability for the provision of those offers or prizes.
- 10.1.6 We reserve in all cases the right to replace the stated prizes with other prizes that we consider to be of broadly equivalent value. We offer no cash alternative for non-cash prizes, and prize winners must accept prizes in the form offered. Prizes are not refundable or transferable.
- 10.1.7 The winner may be required to sign a statement proving their eligibility/liability.
- 10.1.8 The closing date for receipt of entries is as stated for each individual competition. The winner(s) will be drawn at random from all valid entries, and will be notified by email within two weeks of the closing date.
- 10.1.9 Detail of the winner(s) can be obtained by sending a SAE marked [name of competition] to Cricket Properties Ltd, Fourth Floor Bedser Stand, The Kia Oval, Kennington, London, SE11 5SS, United Kingdom within 21 days of the closing date of the promotion.
- 10.1.10 All entrants to competitions and offers are deemed to have accepted these rules and agree to be bound by them, and agree to co-operate in any publicity that may arise which may include their name or image being used on websites, magazines or mobile services at any time as a result of the competition.
- 10.1.11 Some cricket equipment given away in competitions may have been used for testing purposes.

- 11.1 Certain pages on this Website display third party advertising. CPL has neither control over, nor involvement in, any third party advertising or the products and/or services featured therein.

Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.
- 20.2 CPL may from time to time send you information about our products and/or services. If you do not wish to receive such information, please click on the ‘Unsubscribe’ link in any email which you receive from us.
21. Law and Jurisdiction
- These terms and conditions and the relationship between you and CPL shall be governed by and construed in accordance with the Law of England and Wales and CPL and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
